E-COMMERCE (ACCOMMODATION RESERVATIONS). General contracting terms and conditions
This contractual document will govern the booking of accommodation reservations via the website www.hotelquintasolera.com, owned by ASR Turismo y Eventos, S.L., operating under the trade name “Hotel Quinta Solera” (hereinafter, “the PROVIDER”), whose contact details are also listed in the Legal Notice of this Website.
These Conditions shall remain published on the Website for the USER’s consultation, download or printing, and may be modified at any time by the PROVIDER. It is the USER’s responsibility to read them periodically, as the version in force at the time the reservation is made will apply.
Contracts will not be subject to any formal requirement except in the cases expressly provided for in the Civil and Commercial Codes and in applicable legislation.
Acceptance of these Conditions implies that the USER:
Has read, understands, and accepts its content.
Is of legal age and has the legal capacity to contract.
Agrees to be bound by the terms set forth herein.
These Conditions will remain valid indefinitely until they are modified. The PROVIDER acknowledges the legislation in force in the countries to which it offers its services and reserves the right to unilaterally amend these conditions, without affecting reservations that were already formalised.
1. Identity of the contracting parties
On the one hand, the PROVIDER of the accommodation booking service contracted by the USER is ASR Turismo y Eventos, S.L., with registered office at C/ Quintanal, 13, 33140 El Puerto‑Oviedo (Asturias), Spain, Tax ID B21731047 and telephone number 609 228 747.
On the other hand, the USER making the booking through the website, who is responsible for the accuracy of the personal information provided to the PROVIDER.
2. Object of the contract
This contract is intended to regulate the contractual relationship between the PROVIDER and the USER at the moment the USER accepts, during the online booking process, a room or stay at the hotel.
Such contractual relationship involves the provision of the selected accommodation service for the chosen dates, in exchange for the price published on the website, in accordance with the specified features, regime and conditions.
3. Booking procedure
In order to access the service, the USER must be of legal age and, if required, create an account on the website by providing the required personal data. These data will be processed in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD).
The USER agrees to make diligent use of their username/password and to immediately notify the PROVIDER of any unauthorised access.
The booking process is subject to the steps required by Law 34/2002 on Information Society Services and Electronic Commerce (LSSICE).
4. General contracting clauses
Unless otherwise agreed in writing, placing a booking with the PROVIDER implies full and unconditional acceptance by the USER of these conditions. Any special condition proposed by the USER that contradicts what is stipulated here will only be valid if it has been expressly accepted in writing by the PROVIDER.
5. Confirmation of booking and payment
The PROVIDER will inform the USER of the procedure to formalise the booking. Payment may be made online or as stipulated in the booking (card, bank transfer, etc.). The booking will not be confirmed until payment has been properly verified.
If the accommodation is not available for the dates specified, the USER may cancel the booking at no cost or request an alternative. The PROVIDER shall not be liable when the unavailability arises from inaccurate data provided by the USER.
6. Cancellations

The USER has the same rights and deadlines to proceed with the cancellation and/or to claim for any faults or defects in the reservation, whether made online or offline.
All cancellations must be communicated to the PROVIDER, requesting a return number through the enabled form, or by email to info@hotelquintasolera.com, indicating the invoice or reservation number.
If the reservation is cancelled more than 30 days before the arrival date: the PROVIDER will refund 50% of the reservation amount.
If the reservation is cancelled less than 30 days before the arrival date: 100% of the reservation amount will not be refunded.
7. Complaints

If any incident occurs during the stay, the USER must notify the PROVIDER immediately. In cases of force majeure (fire, water damage, etc.), the PROVIDER will offer equivalent accommodation or a full refund if not possible.
8. Force Majeure
The parties shall not be held liable for non-compliance due to force majeure. In case of restrictions (e.g., due to COVID‑19) that prevent the USER from arriving, they may use their reservation on a new date or request a full refund.
9. Jurisdiction
The USER may not assign or transfer the rights or obligations acquired through the reservation. If any clause is declared null or unenforceable, the remaining clauses shall remain valid and unchanged.
10. General Terms of the Offer
Details of each room (meal plans, included services, extras) are provided on the specific reservation page. All bookings made through the PROVIDER are subject to these general conditions. The PROVIDER reserves the right to change technical or service characteristics provided these do not substantially alter the value of the reservation.
11. Price and Validity of the Offer
The prices displayed normally include VAT. Unless otherwise stated, tourist taxes, insurance, or additional services are not included. Prices are listed in euros (€) and may be updated until the reservation is finalized. Once confirmed, the price is fixed.
Any payment made will generate an invoice in the name of the USER or the company indicated. The invoice will be issued at the end of the stay and may be downloaded in PDF format, if applicable. The USER may request its delivery by email and may revoke this consent at any time.

12. Transportation Costs
There are no transportation costs.
13. Payment Methods, Fees and Discounts
The PROVIDER offers the following payment methods:

The website employs standard security measures (SSL, secure HTTPS pages, firewalls, access control and cryptographic mechanisms) to protect the USER’s data. The PROVIDER will not accept transactions that are illegal or that violate the rules of the issuing banks or card associations.
14. Booking Process
The website allows the USER to simulate a booking, calculate the price, select dates, room, extras, and confirm. Once the booking is processed, a confirmation email will be sent to the USER and to the PROVIDER’s reservations department. Within a maximum of 24 working hours, the USER will be informed of the status of the booking.
15. Suspension or Termination of the Contract
If any provision of these Conditions is declared invalid, the remainder of the contract will continue in full force and effect. The PROVIDER may suspend or cancel the booking or access to the service without prior notice if the USER fails to fulfill obligations, engages in fraudulent use, or violates applicable regulation, licences or usage policies. This does not prevent the exercise of other rights the PROVIDER may have.
16. Warranties and Refunds
The warranties for the services offered comply with the provisions of Royal Decree‑Law 1/2007 of 16 November. The USER may, as appropriate, demand repair, replacement of the service, reduction of the price or termination of the contract when the service is non‑conforming. Any non‑conformity must be reported at the end of the stay or when detected.
17. Governing Law and Jurisdiction
These Conditions are governed and interpreted in accordance with Spanish law. The PROVIDER and the USER agree to submit to the courts and tribunals of the USER’s place of domicile. If the USER resides outside Spain, both parties waive any other jurisdiction and agree to the alternative dispute resolution mechanism under Art. 14.1 of Regulation (EU) 524/2013.
